25. INDIVIDUAL USE, ADDING PEOPLE, AND PLAN LIMITATIONS

Individual Use: Our services are intended for personal, non-commercial use. You may not use the platform to create, modify, or distribute resumes or cover letters on behalf of individuals not covered by your subscription plan. Any use of the platform for commercial purposes or to provide services to third parties is strictly prohibited, unless expressly permitted by a separate commercial agreement. For such inquiries, please contact us at support@resjo.com.

Person-Based Resume Creation: Our plans are structured around a person-based system. Each person represents a distinct individual for whom resumes can be created and managed. Users are permitted to create and manage resumes only for the number of people included within their active subscription. A person may be oneself or another individual, within the permitted count.

Permanent People: Once added, people are permanently associated with your account and do not expire. You are not required to repurchase people already registered in your account. However, an active base plan is required to access editing or download functionality for any person.

Plan Limitations and Adding People: The number of people and the features available to each person may vary depending on your selected subscription plan. You may upgrade your plan to add more people permanently and to access enhanced features. Additional people may also be purchased independently, subject to an active base plan availability.

Unauthorized Use and Violations: Any attempt to create or manage resumes or cover letters for individuals beyond the number of people allocated to your plan, resell generated content, or manipulate system limitations through unauthorized means constitutes a breach of these Terms of Service. Such violations may result in suspension or termination of your account, and may be subject to legal action.

• The platform is not responsible for any inaccuracies, misrepresentations, or errors in AI-optimized resumes, summaries, or cover letters.

• Once AI Credits are used for a feature, they cannot be refunded, even if the output is unsatisfactory.

• AI features are intended for individual and professional use only.
• Excessive or automated usage of AI features that exceeds normal user behavior may result in temporary or permanent account suspension.

• The generated content is intended to assist users in creating a compelling summary for their LinkedIn profiles.

• Users are solely responsible for reviewing, editing, and ensuring the accuracy and appropriateness of the generated LinkedIn Summary before using it.
• It is the users responsibility to comply with LinkedIns content and community guidelines when publishing summaries generated by the platform.

• The AI-generated summaries are based on user-provided resume content and public professional writing standards but may contain errors or inaccuracies.

28. AI RESUME OPTIMIZATION FEATURE

This section governs your use of our AI-powered Resume Optimization feature, which is designed to analyze a user's resume against a provided job title or job description and create an updated new resume using AI.

• Feature Purpose and Functionality: The AI Resume Optimization feature utilizes artificial intelligence models to generate resume's content, keywords, and structure to better align with the requirements of a specific job description or title. The feature is intended to be an assistive tool to help you identify potential areas for improvement.
• User's Sole Responsibility for Content & Accuracy: You are solely and exclusively responsible for the final content of any resume created or modified using this feature. While the AI provides suggestions based on the data you provide, it is a tool and not a substitute for your own judgment and verification.

We explicitly state that the optimization is performed on a "best efforts" basis. It is your critical responsibility to:
  1. Review and Validate: Thoroughly read, review, and validate all AI-generated content, suggestions, and modifications.
  2. Ensure Truthfulness: Ensure that the final resume accurately and truthfully represents your skills, experience, qualifications, and accomplishments.
  3. Edit and Personalize: Feel free to edit the content, and you must remove any skills, qualifications, or experiences suggested by the AI that you do not actually possess or cannot substantiate. Misrepresenting your qualifications can have serious adverse consequences for your job search and career.
• No Guarantee of Success or Outcomes: ResJo makes no representations, warranties, or guarantees, whether express or implied, that using the AI Resume Optimization feature will result in a job interview, a job offer, employment, or any other positive career outcome. The effectiveness of a resume is highly subjective and depends on numerous factors beyond our control, including but not limited to your overall qualifications, the accuracy of your resume, the competitiveness of the job market, and the discretion of potential employers.
• Disclaimer of AI-Generated Content: You acknowledge that AI models can produce outputs that may be inaccurate, incomplete, contextually inappropriate, or nonsensical. The generated content is provided "as is" and "as available" without any warranties of any kind. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the website, or by anyone who may be informed of any of its contents.
• Usage and AI Credits: Accessing and using the AI Resume Optimization feature will consume AI Credits from your account as specified in your plan details. In accordance with Section 26, AI Credits used for this feature are non-refundable, regardless of your satisfaction with the generated suggestions or the outcome of your job applications.
• Data Usage and Third-Party Providers: To provide this service, we process the resume content and the job description you input through APIs from third-party AI service providers (e.g., OpenAI, Google, etc.). By using this feature, you acknowledge and agree that your data will be transmitted to these external services for processing. The handling of your data by these providers is governed by their respective privacy policies and terms of service. ResJo does not control and is not responsible for the data practices of these third parties. We cannot guarantee that your data will not be used for their own purposes, including but not limited to AI model training. We encourage you to review the privacy policies of our third-party providers. Any data retained on ResJo's own systems is handled in accordance with our Privacy Policy.

29. AI COVER LETTER GENERATION FEATURE

This section governs your use of our AI-powered Cover Letter feature (the "Cover Letter Feature"), which uses artificial intelligence to prepare a draft cover letter from a resume saved in your account. It applies in addition to Section 26 (AI Features & AI Credits) and Section 30 (Fair Use Policy). If this section conflicts with any other provision of these Legal Terms in relation to the Cover Letter Feature, this section will prevail.

• How the Feature Works: You select one of your resumes and may choose to provide a target job title, company name, and job description, select a tone (such as Professional, Enthusiastic, Career Change, or Referral) and, for a referral letter, the name of the person who referred you (together, "Your Inputs"). We use the selected resume and Your Inputs to generate a draft letter (a "Generated Letter"). If you do not provide a job title, a general-purpose letter is generated, which you will need to adapt for each application. You may then edit the text, rename the letter, set the person it is addressed to, choose its layout, font, font size, and accent colour, preview it, copy it, and download it as a PDF.
• AI Credits: Each generation consumes the number of AI Credits shown on the feature page at the time you generate (currently one (1) AI Credit per letter). Credits are deducted only once a letter has been successfully generated and saved to your account; if generation fails, no credit is deducted. Editing, renaming, re-addressing, changing the appearance of, previewing, copying, or downloading a letter you have already generated does not consume further credits. Generating another letter, including a new version for the same job or in a different tone, is a separate generation and consumes credits. Deleting a Generated Letter does not restore any credit. The Cover Letter Feature is available only with an active plan that has sufficient AI Credits, and AI Credits remain subject to Section 26.
• Your Inputs and Information About Other People: You represent and warrant that you are entitled to submit Your Inputs and that doing so will not breach any law, any confidentiality obligation you owe, or the rights of any third party. In particular, you agree that: (a) you will submit a job description only if it has been made available to you for the purpose of applying for that role, and not if you are required to keep it confidential; (b) you will name a person as your referrer only if that person has actually referred you and has agreed, or would reasonably expect, to be named in your application; and (c) you will include another individual's name or details (such as a referrer or the person the letter is addressed to) only to the extent necessary for your application. Do not include sensitive personal information about yourself or anyone else (for example, health information, religious or political beliefs, government identification numbers, or financial account details) unless you intend it to appear in your letter.
• Accuracy and Your Responsibility: A Generated Letter is written in the first person, in your name, for you to send to prospective employers. It is a draft only. The AI is instructed to rely only on your selected resume and Your Inputs, but AI models can still produce content that is inaccurate, incomplete, overstated, generic, or not supported by your resume, and may repeat the wording of a job description.

Before you send any letter, you must:
  1. read it in full and correct or remove any statement that is not true of you;
  2. replace every placeholder shown in square brackets, such as [Company Name], [Referrer name], or [Your Name];
  3. confirm that the role, company, recipient, and date are correct; and
  4. confirm that the name and contact details in the letterhead, which are taken from your selected resume, are current.
The date on a letter is inserted automatically when the letter is previewed or downloaded. You are solely responsible for the content of every letter you send, and for complying with any rules a prospective employer may set regarding the use of AI tools in job applications.
• Prohibited Uses: In addition to Section 6 (Prohibited Activities), you must not use the Cover Letter Feature to: (a) misrepresent your identity, qualifications, experience, or any referral; (b) create a letter in the name of any other person, except for a profile you are permitted to manage under Section 25; (c) generate letters in bulk, by automated means, or as a paid or commercial service for others; or (d) create content that is unlawful, defamatory, or discriminatory, or that infringes the rights of any person.
• No Guarantee of Outcomes: ResJo does not warrant that any Generated Letter will be accurate, error-free, original, or suitable for any particular employer or role, or that it will lead to an interview, a job offer, or any other outcome. Similar inputs may produce similar letters for different users. The Cover Letter Feature does not provide career, legal, immigration, or other professional advice. Generated Letters are provided "as is" and "as available", and Sections 20 (Disclaimer) and 21 (Limitations of Liability) apply to them in full.
• Ownership and Licence: As between you and us, and to the extent permitted by applicable law, you own Your Inputs and your Generated Letters, and we assign to you any rights we may have in the text of your Generated Letters. You grant us a limited, non-exclusive, royalty-free licence to host, store, copy, process, transmit, and display Your Inputs and Generated Letters solely to provide, secure, and support the Cover Letter Feature for you, including by transmitting them to our AI and document-rendering service providers. Your cover letters are private to your account. They are not publicly posted Contributions under Sections 2, 7, and 8, and we will not publish them or use them for advertising. The layouts, designs, and templates used to present your letter remain our Content under Section 2.
• Data Processing and Third-Party AI Providers: To generate a letter, we send your name, the professional content of your selected resume (such as your summary, job titles and responsibilities, education, skills, projects, awards, certifications, and accomplishments), and Your Inputs to a third-party AI service provider (such as Google Cloud Vertex AI). The contact details on your resume, such as your email address, phone number, location, and profile links, are not sent to the AI provider for this purpose; our own systems add them to your letter when it is previewed or downloaded. By using the Cover Letter Feature, you acknowledge and agree to this transmission. The "Data Usage and Third-Party Providers" provisions of Section 28 apply equally to this feature, and our Privacy Policy explains how we handle your data.
• Storage, Deletion, and Retention: Each Generated Letter is saved to your account automatically, together with its job title, company name, job description, tone, recipient name, and appearance settings, so that you can return to edit or download it. A referrer's name is used to generate the letter and is not stored as a separate field, but it will remain in the letter text if the letter includes it. You may delete any letter at any time. A deleted letter is removed from your account immediately, and any remaining copy is permanently deleted in accordance with our Privacy Policy, including when you delete your account. Deleting a resume does not delete the cover letters created from it, and those letters keep the name and contact details they were built with. You will not be able to change that letterhead once the resume is deleted, because it is edited through the resume. We recommend that you keep your own copy of any letter you send; Section 23 (User Data) applies.
• Availability and Changes: The Cover Letter Feature may not be available on every platform, plan, or region. We may modify, limit, suspend, or discontinue it, including its tones, layouts, AI providers, and credit cost, in accordance with Section 16 (Modifications and Interruptions). A change to the credit cost will not apply to letters you have already generated.

You further agree that any violation of these terms may result in the actions outlined above, and we retain the right to make such decisions at our sole discretion.

31. MISCELLANEOUS
